Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ShadowsDeal’s website, online store, content, products, features, and related services (collectively, the “Services”). By using the Services or placing an order, you agree to these Terms and the policies linked on this page. Do not use the Services if you do not agree.

1. Store operator and Shopify

ShadowsDeal operates this store. Shopify provides the ecommerce platform that enables the Services, but purchases are made directly from ShadowsDeal. Shopify is not the seller of products offered by ShadowsDeal.

2. Eligibility and accounts

You must be able to enter a binding agreement in your jurisdiction to make a purchase. Information provided through the Services must be accurate, current, and complete. You are responsible for protecting account credentials and for activity conducted through your account.

3. Products, photos, and descriptions

We work to present products accurately, but screen settings, lighting, packaging changes, resale condition, and inventory variation can affect appearance. Product descriptions, availability, and pricing may be corrected or changed at any time.

Some products are mystery lots, assortments, collectibles, vintage items, closeout goods, or secondary-market inventory. Exact designs, years, characters, styles, packaging, and item mixes may vary unless a listing specifically guarantees them. Read the full description and selected variant before ordering.

4. Independent reseller status

Unless a listing expressly says otherwise, ShadowsDeal is an independent reseller and is not the manufacturer, trademark owner, government agency, authorized distributor, or official representative of third-party brands or agencies referenced on the site. Brand, character, and agency names are used for product identification and description. See our Independent Reseller Notice.

5. Orders and acceptance

Submitting an order is an offer to purchase. We may accept, reject, limit, hold, or cancel an order for reasons including inventory, pricing or listing errors, payment review, suspected fraud, shipping restrictions, or quantities that appear inconsistent with normal consumer use. An order is accepted when we confirm it for fulfillment. If an order is canceled after payment, the applicable amount will be returned to the original payment method.

6. Prices, promotions, taxes, and fees

Prices and promotions may change without notice. The amount charged is the amount shown at checkout and in the order confirmation, subject to correction of obvious errors. Taxes, shipping charges, customs duties, and other fees may apply as displayed or required. Promotional terms control when they conflict with general promotional language elsewhere on the site.

7. Payment

You represent that you are authorized to use the payment method submitted and authorize the charge for your order. Payments are processed through Shopify and available payment providers. We do not guarantee that every payment method will be available for every transaction.

8. Shipping, delivery, returns, and refunds

Shipping and delivery estimates are not guarantees. Orders are subject to our Shipping Policy. Returns, exchanges, cancellations, and refunds are governed by our Returns & Refunds Policy.

9. Lawful use

You may use the Services only for lawful purposes. You may not misuse the Services; interfere with security or operation; upload malware; scrape or harvest information without authorization; impersonate another person; submit false or misleading information; violate intellectual-property, privacy, or other rights; engage in fraud; or use the Services in a manner that could harm ShadowsDeal, Shopify, other users, or third parties.

10. Intellectual property

Store design, original text, graphics, logos, photographs, video, and other original content are owned by ShadowsDeal or used under license and are protected by applicable intellectual-property laws. Limited personal, noncommercial access is permitted. No content may be copied, republished, distributed, modified, sold, or commercially exploited without permission, except as allowed by law. Third-party trademarks remain the property of their respective owners.

11. Reviews, feedback, and submissions

You are responsible for content you submit. It must be truthful, lawful, relevant, and must not violate another person’s rights. By submitting reviews, images, suggestions, or other content, you grant ShadowsDeal a nonexclusive, worldwide, royalty-free license to host, reproduce, adapt, publish, and display it for operating and promoting the Services. We may moderate or remove submissions where permitted.

12. Third-party tools and links

The Services may include tools, apps, payment methods, or links provided by third parties. Those services are governed by their own terms and policies. ShadowsDeal is not responsible for third-party content or services outside our control. Review their terms before use.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy. Depending on your location, additional controls may be available on the Your Privacy Choices page.

14. Errors and availability

We may correct typographical errors, inaccurate descriptions, prices, promotions, shipping charges, transit estimates, or availability information, including after an order is submitted. We may suspend, modify, or discontinue any part of the Services without guaranteeing continued availability.

15. Disclaimer of warranties

To the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” except for warranties expressly provided in writing or rights that cannot legally be excluded. We do not guarantee uninterrupted, error-free, or completely secure access to the Services.

16. Limitation of liability

To the fullest extent permitted by law, ShadowsDeal and its service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, lost profits, lost data, or similar losses arising from the Services or products. Where liability cannot be excluded, it is limited to the maximum extent allowed by law. Nothing in these Terms excludes liability that cannot legally be excluded.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold ShadowsDeal harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your violation of another person’s rights.

18. Suspension and termination

We may restrict or terminate access when we reasonably believe the Services are being misused or these Terms have been violated. Provisions that by their nature should survive termination will remain effective.

19. Governing law and severability

These Terms are governed by laws applicable in Ohio, United States, without limiting any mandatory consumer rights that apply where you live. If a provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue in effect.

20. Changes and entire agreement

We may update these Terms by posting a revised version with a new “Last updated” date. These Terms, together with incorporated store policies and any specific promotion or product terms, form the agreement governing use of the Services. A failure to enforce a provision is not a waiver.
